THE TENTH SESSION OF THE ISLAMIC SUMMIT CONFERENCE

(SESSION OF KNOWLEDGE AND MORALITY FOR THE PROGRESS OF UMMAH)

1.              The Heads of State or Government, as the leaders of the Islamic Ummah, reaffirmed the centrality of the cause of Al-Quds Al-Sharif and Palestine to the entire Ummah.  They reaffirmed that, as the first Qiblah and the third holy sanctuary, Al-Haram Al-Sharif and Al-Quds Al-Sharif, as blessed by God, shall forever remain Islamic.  They stressed the necessity for Al-Quds Al-Sharif and its holy places to be under Palestinian sovereignty, paving the way for true freedom of worship by the believers of all three monotheistic religions and for a genuine reconciliation and lasting peace in the Middle East region.

 

2.              The Heads of State or Government strongly condemned all attempts by Israel, the occupying Power, to judaize Al-Quds Al-Sharif and to change the Arab character, nature and demographic composition of the city.  They recalled in this regard the many relevant Security Council resolutions on all illegal Israeli measures, including measures and actions taken by Israel to change the status, characted and demographic composition of Al-Quds, which are null and void, and called for full implementation of those resolutions.  They further reiterated their solidarity with the Palestinian inhabitants and institutions of Al-Quds Al-Sharif in their steadfast resilience and affirmed their determination to provide them with the necessary support to preserve.  They reiterated their full support for the valuable work carried out by the Committee of Al-Quds and expressed their appreciation to its Chairmanship.

 

3.              The Heads of State or Government, recalling the historic injustices inflicted upon the Palestinian people, reiterated their principled support for and longstanding solidarity with the Palestinian people and their national legitimate leadership.  They recalled, in this regard, that in 1948 more than half of the Palestinian people were uprooted from their land, homes and properties, dispossessed and forced to live as refugees until today, awaiting the implementation of United Nations resolution 194 (III).  They also recalled that the establishment of the State of Palestinian, in accordance with United Nations resolution 181 (II), has been obstructed for more than fifty years.  They further recalled that the remainder of the Palestinian Territory has been under the foreign occupation of Israel since 1967, and that, since that time, the Palestinian people in the Occupied Palestinian Territory, including Al-Quds Al-Sharif, have been subjected to the continuous oppression and brutality of the occupation, including an active campaign of settler colonialism and expansionism.

 

4.              The Heads of State or Government expressed their deep concern at the tragic situation prevailing in the Occupied Palestinian Territory, including Al-Quds Al-Sharif, since 28 September 2000.  They strongly condemned the war crimes and

 

systematic human rights violations that have been committed by the Israeli occupying forces against the Palestinian people.  They condemned in particular the

willful killing of Palestinian civilians, including extrajudicial executions; the excessive and indiscriminate use of force, resulting in extensive loss of life and injury; the wanton destruction of homes, infrastructure and agricultural lands; the detention and imprisonment of thousands of Palestinians;  and the imposition of collective punishments on the entire Palestinian population, including severe restrictions on the movement of persons and goods and prolonged curfews, resulting humanitarian crisis.  The Heads of State or Government further condemned the settler colonialism that has been carried out by Israel, the occupying Power, in the Occupied Palestinian Territory, including Al-Quds Al-Sharif, since 1967, through land confiscation, settlement building and the transfer of Israeli nationals to the Occupied Territory.

 

5.              The Heads of State or Government reiterated their unwavering support for the realization of the inalienable rights of the Palestinian people, including the right to national independence and the exercise of sovereignty in their State, Palestine, with Al-Quds Al-Sharif as its capital.  They reaffirmed the responsibility of the international community, particularly the permanent responsibility of the United Nations, including the Security Council, until the question of Palestine is resolved in all its aspects.

 

6.              The Heads of State or Government reaffirmed their support for the peaceful settlement of the question of Palestine and the situation in the Middle East in accordance with international legitimacy and supported all international efforts in their regard.  They expressed the hope that the whole region would live in peace, security, safety and prosperity free from all forms of terror and violence.

 

7.              The Heads of State or Government reaffirmed their commitment to ensuring the sanctity, dignity and Islamic nature of Al-Haram Al-Sharif and striving for the sovereignty of Al-Quds Al-Sharif as the capital of the State of Palestine.

In the name of Allah, the Compassionate, the Merciful

 

Their Majesties, Highnesses and Excellencies, Kings and Heads of State and Government of the OIC Member States assembled in the Tenth Session of the Islamic Summit Conference (Session of Knowledge and Morality for the Progress of the Ummah) held in Putrajaya, Malaysia, from 16 to 17 October 2003.

 

Strongly condemn the military aggression which was committed by Israel against the airspace and territory of the Syrian Arab Republic and the Republic of Lebanon on the 5th of October 2003 in a blatant violation of the Charter of the United Nations, and the principles of International Law and Security Council Resolutions 242 (1967), 338 (1973), 350 (1974), 425 (1978) and 497 (1981), and deem that aggression as an irresponsible violation of the Disengagement Agreement concluded between Syria and Israel on 31st May 1974.

 

Call on the Security Council of the United Nations, as the body entrusted with the maintenance of international peace and security, to take the necessary measures to force Israel to desist from such terrorist aggressive acts or threats of acts as they constitute a serious escalation in the Middle East that endangers both regional and international peace and security, aggravates the deteriorating condition in the region and leads to dire consequences.

 

 

Request the Security Council to compel Israel to respect the Disengagement Agreement in the Occupied Syrian Golan, implement United Nations resolutions in particular 242 (1967) and 338 (1973), and withdraw from the occupied Arab territories to the line of the 4th of June 1967.

 

Stress that the Israeli aggression against the Syrian territories is a gross defiance to the Islamic Ummah, express their full solidarity with Syria and its responsible stance embodied in resorting to the international legitimacy and not be drawn into the Israeli policies of escalation and provocation.

 

Denounce the American Congress’ Accountability Act to impose unilateral sanctions on Syria, which coincided with the Israeli aggression against it. They reconfirm their absolute solidarity with Syria and their countries’ rejection of the Congress Accountability Act that would encourage Israel to persist in its aggression and challenge of the international legitimacy. They also urge the U.S. Administration to adopt a policy of constructive dialogue and mutual respect as a basis for understanding among nations and peoples.

 

 

DECLARATION ON JAMMU AND KASHMIR

THE TENTH SESSION OF THE ISLAMIC SUMMIT CONFERENCE

(SESSION OF KNOWLEDGE AND MORALITY FOR THE PROGRESS OF UMMAH)

The Meeting of the OIC Contact Group on Jammu and Kashmir held on the margins of the OIC Summit Conference at Kuala Lumpur on 16 October 2003 October 2003;

Recalling the UN Security Council and OIC Resolutions providing for a plebiscite in the Indian Occupied State of Jammu and Kashmir to enable the Kashmir people to exercise their right to self-determination;

Also-recalling the principle embodied in the relevant UN Security Council and United Nations Commission for India and Pakistan ( UNCIP) resolutions, that the final disposition of the State of Jammu and Kashmir will be made in accordance with the will of the people expressed through the democratic method of a free and impartial plebiscite conducted under the auspices of the United Nations;

Expressing serious concern over the intensification of repression and the continued violation of the human rights of the Kashmiri people, including the denial of their inalienable right to self-determination;

Gravely concerned that in disregard of its obligations under the Universal Declaration on Human Rights and the relevant Conventions, including Geneva Convention, India has continued to violate, with impunity, fundamental human rights of the Kashmiri people;

Alarmed over the continued tension in South Asia caused by India's refusal to reduce deployment of its forces along the Line of Control and the Working Boundary in Jammu and Kashmir;

Regretting that India has rejected Pakistan's proposal for a reciprocal ceasefire along the Line of Control and within the Indian occupied Kashmir and also the repeated offer of enhanced monitoring of the LoC on both sides in Kashmir;

Deeply disappointed that India has sought to evade resumption of dialogue for resolution of differences and finding a peaceful solution on the pretext of cross border infiltration and in this context notes with regret that India has refused and rejected proposals for verifiable monitoring of the Line of Control.

Deeply disturbed that the introduction of nuclear weapons in South Asia has made such tension infinitely more dangerous, and cognizant of the terrible consequences of a war between Pakistan and India;

Aware that the sham elections held in the Indian occupied State o f Jammu and Kashmir are not a substitute to the plebiscite under UN auspices in accordance with the UN Security Council and UNCIP Resolutions;

Reaffirming the principle laid down in UN Security Council Resolutions 47 (1948), 91 (1951) and 122 (1957), according to which the final disposition of the State of Jammu and Kashmir will be made in accordance with the will of the people expressed through the democratic method of a free and impartial plebiscite conducted under the auspices of the United Nations, and that any action taken otherwise to determine the future shape and affiliation of Jammu and Kashmir would not constitute a disposition of the State in accordance with the above principle;

Noting the Memorandum submitted by the True Representatives of the Kashmiri people; -

Further noting the report of the OIC Contact Group on Jammu and Kashmir;

1. Reaffirms all OIC Summit and Ministerial resolutions on the Jammu and Kashmir dispute.

2. Calls for a peaceful settlement of the Jammu and Kashmir dispute in accordance with relevant UN Resolutions and as agreed upon in the Simla Agreement.

3. Welcomes the President of Pakistan's proposal for a ceasefire along the LoC and in the valley which was a step in the right direction and regrets that India has not responded positively to the appeal;

4. Condemns the massive human rights violations being committed by the Indian forces in the Indian held Jammu and Kashmir, and to put an end immediately to these violations.

5. Calls upon India to put an end to its repressive policies and massive human rights violations in the Indian Occupied Jammu and Kashmir;,

6. Urges the international community to take effective steps for safeguarding the human rights of the Kashmir people including their right to self-determination and stresses the importance of sustained international engagement to facilitate a just and peaceful solution of the Kashmir dispute.

7. Reaffirms that the sham elections held in the Indian Occupied Jammu and Kashmir cannot be a substitute for the free and impartial exercise of the right to self-determinaton by the people of Jammu and Kashmir under UN auspices as determined by the UN Security Council Resolutions 47 (1948), 91 (1951) and 122 (1957) of the UN Security Council which had unambiguously affirmed that "any action that the Indian Government may have taken, or might attempt to take to determine the future shape and affiliation of Jammu and Kashmir would not constitute a disposition of the State";

8. Welcomes the visit of the OIC Fact Finding Mission to Azad Kashmir from 20-23 April 2003 that helped in generating fresh hopes and confidence amongst the Kashmiris, and urges the government of Indian to allow the OIC fact-finding mission to visit the Indian occupied Kashmir;

9. Calls upon India to cooperate with Pakistan, the UN and the international community to accept the strengthening of the UNMOGIP and provide it full support.

10. Supports the ongoing efforts of the Government of Pakistan for a peaceful resolution of the Kashmir dispute and urges India to enter into a meaningful and sustained dialogue process with Pakistan to resolve all outstanding issues including the core issue of Jammu and Kashmir.

11.Deplores the restrictions imposed by India on the freedom of travel of the leaders of the All Parties Hurriyat Conference (APHC), the true representatives of the Kashmiri people.

12.Affirms once again the commitment of the OIC to promote a just and peaceful solution to the Jammu and Kashmir dispute in accordance with United Nations resolutions and expressed the resolve to seek the realization of the right of self-determination of the Kashmiri people.

13.Decides that the OIC Contact Group on Jammu and Kashmir should continue to meet during sessions of the UN General Assembly and the UN Commission on Human Rights as well as at the OIC Ministerial meetings.
